Robert Fabian was a friend of Earl Avery. Robert's wife (at the time, Cindy Fabian), is the sister of Candy Avery, who was Earl Avery's wife back in 2005. Robert Fabian spoke to law enforcement during the investigation and testified at Steven Avery's trial.

The following four law enforcement interviews are either of Earl Avery or mention his, Robert Fabian and Steven Avery's movements, from October 31st, 2005 to November 5th, 2005. These interviews predate Robert Fabian's interview on November 10th, 2005 in which he contradicts what they had said.

1) Regarding your first interview with law enforcement on November 10th, 2005. You state that you were on the Avery Salvage Yard (ASY) and went rabbit hunting with Earl Avery there on October 31st, 2005 (Monday).

Earl Avery (on November 5th, 8th and 9th), Bryan Dassey (on November 6th) and Candy Avery (told to you by Theresa Lnu); all say that is was November 2nd, 2005 (Wednesday) and not October 31st (Monday) when you were rabbit hunting with Earl at ASY - are they all mistaken about the day, or are you mistaken?

2) Still regarding your first interview with law enforcement on November 10th, 2005. You say that you first see Steven Avery at around 16:30 p.m. on October 31st, 2005. You also see and speak to Charles (Chuck) Avery.

a) You describe Steven Avery as wearing; "a cream colored shirt, sleeveless, with a pair of blue jeans". Is that exactly what you told law enforcement, if it is, could you really remember on November 10th what Steven Avery had been wearing on 'October 31st'?

b) You tell law enforcement that not long after 16:30 p.m., when you first see Steven and Chuck, that you overhear Chuck asking Steven 'if the photographer had arrived yet?' You say that you then say to Chuck; "A photographer? Are you getting your picture taken?". You say Chuck then explains a photographer is coming to take photos of vehicles to put in Auto Trader. You then say Steven replies to Chuck 'no, she hadn't shown up yet'. Do you stand by your statement that not only did this conversation took place, but it took place on October 31st, 2005?

c) You say that after first going rabbit hunting with Earl in the lower pit area, you both drive back up into the yard and drive down Avery Road towards Steven Avery's residence. Your statement to law enforcement then states the following; 'ROBERT while riding in the golf cart on Avery Rd. observed STEVEN AVERY exit his residence and walk towards his black pickup truck, which has a trailer with a snowmobile on the trailer. ROBERT indicates STEVEN had changed his clothes. It has appeared STEVEN has cleaned up. STEVEN is now wearing a white short sleeve t-shirt and blue jean shorts. ROBERT FABIAN observes something different in STEVEN AVERY's behavior. ROBERT FABIAN describes STEVEN's behavior as different and more quiet. EARL and ROBERT stop the golf cart and ROBERT FABIAN asks STEVEN if he would like to buy a Polaris instead of the black 700 Skidoo Z machine, which is on the trailer. ROBERT FABIAN describes this as a joke in which ROBERT and STEVEN kid each other. ROBERT FABIAN responds, STEVEN's
response is very quiet and seems unamused. ROBERT recalls EARL asking STEVEN what he is doing with the snowmobile. STEVEN indicates, "He is taking the sled up north." ROBERT describes STEVEN's black truck with attached trailer and snowmobile as facing STEVEN's detached garage. He describes the truck as parked, blocking a side of the garage overhead door. He indicates the detached garage door is closed. ROBERT observes a smoke-burning coming from a burn barrel, located north of the driveway on STEVEN AVERY's residence. EARL and ROBERT leave on the golf cart driving a brush pile line looking for rabbits'. Did you tell law enforcement that there was a trailer attached to Steven's pickup and that there was a snowmobile on the trailer?

d) Did you say that Steven had changed clothes and then describe exactly what he was wearing?
​
e) Did you say that Steven had appeared to have cleaned up? What made you say that, why did you not say that he appeared dirty earlier when you described him wearing different clothes?

f) Did you tell law enforcement that you observed something different in Steven's behavior, that he appeared different and more quiet; and that his response to your joke was very quiet and unamused?

3) Still regarding your first interview with law enforcement on November 10th, 2005. In your statement, after it says; 'EARL and ROBERT leave on the golf cart driving a brush pile line looking for rabbits'; the following is also attributed to having been said by you;
ROBERT observes an older DASSEY boy who he believes is either, BRYAN or BOBBY with STEVEN standing on opposite ends of the pickup truck. ROBERT describes the DASSEY boy as wearing a white T-shirt with print on the front. ROBERT indicates it appears as though STEVEN is ready to go up north. ROBERT does not remember seeing any cars or any other vehicles in the driveway of STEVEN's residence. ROBERT said he and EARL did not stop, however, ROBERT yells he should buy a Polaris instead of STEVEN's Skidoo. ROBERT indicates he believes STEVEN seemed very quiet, not himself, on the evening of 10/31/05. ROBERT believes EARL also seemed different as well that day. ROBERT does not remember seeing any cars in the crusher on Monday. ROBERT does not recall seeing anything unusual in the area where the human bones were located. ROBERT says he is home by 6:00 p.m., Monday, 10/31/05. ROBERT estimates it takes approximately 10 to 15 minutes from his residence in Mishicot to get to the AVERY SALVAGE YARD.

a) Why would Steven and other family members be getting things ready to take up north, such as the snowmobile, at the very start of the week - Monday 31st?

b) You state that you were home by 18:00 p.m. on the day you claim to have been at ASY, which you say was October 31st, 2005 (Monday). This means you have left ASY at around 17:45 p.m., is that correct?

4) Still regarding your first interview with law enforcement on November 10th, 2005. In your statement. Towards the end of the statement, the following words are attributed to you and your wife at the time, Cindy;
​
CINDY FABIAN thinks STEVEN is fully capable of sexually assaulting, killing and having
domestic violence against women. ROBERT also thinks STEVEN is fully capable of doing this. The FABIANS, CINDY and ROBERT, indicate EARL AVERY also has violent tendencies. CINDY says that CANDY has told her of abuses in which CANDY has been dragged by her hair upstairs and raped. CINDY also informs investigators they lived at the AVERY SALVAGE YARD until one night when EARL lifted up her daughter's skirt with his foot. Shortly thereafter, the FABIANS left the AVERY SALVAGE YARD residence where they were staying. ROBERT FABIAN also describes STEVEN as very weird when it comes to dealing with women. ROBERT FABIAN JR. describes STEVEN's comments as, "if it's a hole mentality or mind-set."

a) Is the statement accurate regarding what you and Cindy reportedly said about Steven and Earl Avery??

b) If what you say about Earl Avery is true, why did you remain friends with him and still obviously enjoy spending time with him at ASY?

5) Earl Avery was reinterviewed by law enforcement on November 11th, 2005, this was the day after you were first interviewed. Earl's statement is considerably different from when he was interviewed on November 5th, 8th and 9th. Earl now agrees much more with what you said, he says that the rabbit hunting and talking to Steven Avery at the salvage yard happened on Monday October 31st, 2005, not Wednesday November 2nd, 2005.

6) You were interviewed again by law enforcement on November 30th, 2005. Earl Avery was then interviewed again straight after on the same day.

a) You state in your November 30th interview that you are 100% certain the day you went rabbit hunting with Earl Avery at the salvage and spoke to Chuck and Steven Avery was Monday, October 31st, 2005. Do you stand by that as being true?
​

b) In your first interview on November 10th, 2005, you state that you got home from the Avery Salvage Yard at around 18:00 p.m., this means you must have left there around 17:45 p.m. In your second interview with law enforcement on November 30th, 2005, you say that you returned home around 17:30 p.m., this means you must have left the Avery Salvage Yard at around 17:15 p.m. What prompted you to change the time you left the Avery Salvage Yard by around 30 minutes?

c) Earl Avery had an appointment at Dr Daniels Eyecare on October 31st, 2005. According to a lady who worked there (Julie Tisler), Earl Avery must have left there at around 17:30 p.m. on October 31st, 2005. Earl must have arrived at the Dr Daniels Eyecare no later than 17:25 p.m. as Julie Tisler states Earl was only there 5 minutes. It takes a minimum of 20 minutes to get to the mall and to Dr Daniels Eyecare from the Avery Salvage Yard. Earl Avery says you both left the salvage yard at the same time on October 31st, 2005. Earl would have to have left the salvage yard at 17:05 p.m. at the very latest to get to the mall and the Eyecare place by 17:25 p.m. Can you confirm what time you left the Avery Salvage Yard on October 31st, 2005 and what time you arrived home?

d) In your November 30th, 2005, statement it is stated that you said;

Around 8:00 a.m. on Thursday,ll/03/05, ROBERT FABIAN states he did observe a green jeep
backed all the way up at a parking area on STH 147 by the river. ROBERT described this area
as a turnaround. ROBERT recalls seeing this jeep at 8:00 a.m. because he had seen a male
subject talking on TV about a green jeep being in the area.

Did you tell law enforcement you saw a green 'jeep' or did you say a green SUV or perhaps a green truck, what exactly did you say?

7) You testified at Steven Avery's trial in February 2007. In your testimony you change the time you arrived at the Avery Salvage Yard from 16:30 p.m. (which is what you said in your law enforcement interviews) to 16:45-16:50 p.m. You also change the time you got home to 17:45 p.m., which had changed from 17:30 p.m. and 18:00 p.m. in your interviews with law enforcement.

a) What prompted you to change the times (again) for when you arrived at, and left the Avery Salvage Yard, would your memory not have been more accurate back in November 2005 compared to February 2007?
​

b) You don't mention seeing Steven Avery or Chuck Avery when you first got to the Avery Salvage Yard, nor do you mention the conversation you supposedly had with them. Why did you not mention this when you had mentioned it in all your law enforcement interviews in November 2005?
​
​
c) In your trial testimony you state that at 17:20 p.m. you see smoke coming from a burn barrel near Steven Avery's trailer. You also say that you smell burning plastic and that you also see Steven Avery come out of his trailer. As mentioned in question 6c, Earl Avery had an appointment at Dr Daniels Eyecare and he must have left the Avery Salvage Yard at no later than 17:05 p.m. on October 31st. This means it is impossible for you and Earl to still be at the Avery Salvage Yard and see Steven Avery at 17:20 p.m. How do you explain this?
